Terms and Conditions
General event and contract terms between the organizer and the customer apply exclusively to the following event and contractual terms.
1. Area of Application
e|motion sells tickets for tennis events to resellers, corporate customers and individual customers (hereinafter referred to as “customers”). For legal transactions between e|motion and the customer, only the following general terms and conditions (hereinafter “GTC”) apply in their current version. Deviating conditions of the customer will not be recognized by e|motion unless e|motion has explicitly agreed to the validity in a written form.
2. Return and exchange of tickets / loss of tickets
A return or exchange of tickets is generally excluded. This also applies if one or more players cancel their participation in the tournament or if matches will not take place. If matches get cancelled due to force majeure (rain, storm, etc.), there is no entitlement to reimbursement or subsequent price reductions. If a tournament day is completely cancelled and therefore an addiational tournament day is organized, a replacement ticket will be issued upon presentation of the corresponding ticket (VIP services are excluded). If the additional tournament day is also cancelled, there is no entitlement. The exchange, return or assertion of the claim for reimburstment must take place immediately, but at the latest within two weeks after the cancellation of the event day. Any further claims of the customer are excluded.
Please note that for contracts for the provision of services in the areas of accommodation for purposes other than residential purposes, transportation of goods, motor vehicle rental, delivery of food and beverages and for the provision of other services in connection with leisure activities, there is no right of withdrawal or return (§ 312g Abs. 2 S.1 Nr.9 BGB) if the contract for the provision stipulates a specific date or period. Every order for tickets is therefore binding.
3. Liability / Compensation
Claims for damages by the customer against e|motion are excluded, unless they are based on intent, gross negligence, culpable violation of essential contractual obligations, the lack of a guaranteed quality or initial inability or if they concern an injury to life, limb or health. This limitation of liability also applies to employees and relationships as well as vicarious agents of e|motion.
4. Data Protection
e|motion is entitled to process and store the customer’s data received in connection with the business relationship in accordance with the Federal Data Protection Act. In the event that pictures and / or sound recordings such as radio or television recordings are made by authorized persons during a game, the customer agrees that they may be recorded in pictures and / or words and the recordings without any claim may be sent or published for remuneration.
5. House Rules
The customer accepts the following house rules and commits to notify each buyer when purchasing the tickets: e|motion requires proof of the corresponding authorization for all reduced admission tickets before admission. Discounts must be proven with photo ID before entrance. If the proof is not provided, the difference to the full ticket price must be paid before admission. Missiles, pocket knives or other dangerous objects are not permitted and must be handed in at the entrance. Animals are not allowed on the venue. Entrance is prohibited to heavily drunk people.
Sound, film, photo and video recordings of any kind are prohibited for copyright reasons. This also applies to mobile devices with a photo function. In the event of violations, e|motion and its employees are entitled to collect the recording devices and cameras and keep them until the event for a fee. Films and recording materials of any kind on which parts of the event are recorded can be confiscated and kept by the organizer. They will be returned to the owner after he agreed to the previous deletion of the recording. The organizer reserves the right to change the announced tournament schedule (Court assignment and schedule) at short notice. There is no entry during the game. Exceptions such as admission during breaks is possible. The use of mobile phones is prohibited while a match is in progress. Bringing food and beverages is prohibited. Access to the site is free after 8.00 p.m., however, without authorization for the Centre Court. When you leave the event location, the admission ticket loses its validity.
6. Applicable law / Place of Performance and Place of Jurisdiction
German law apllies to the exclusion of the UN sales law.
The place of performance and place of jurisdiction for all claims arising between e|motion and the customer from the business relations is Stuttgart, provided the customer is a registered merchant, legal entity under public law or special fund under public law.
